1. Who you are contracting with
These Terms form an agreement between you and SelaDevs ("SelaDevs", "we", "us"), the operator of the SelaBooth service ("Service"). By creating an account or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm you have authority to bind that business. Individuals must be of legal age to enter a contract.
2. The Service
SelaBooth is a software-as-a-service photo booth platform including event management, kiosk capture, template builder, gallery, printer control, sharing tools, and analytics. Features available to you depend on your subscription plan.
3. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- use the Service unlawfully or to violate any third-party rights;
- upload, generate, or share content that is illegal, infringing, defamatory, or violates privacy;
- send spam, engage in fraud, or attempt to deceive guests or payment processors;
- probe, scan, scrape, reverse-engineer, or interfere with the security or integrity of the Service;
- introduce malware or attempt to gain unauthorised access to any account or system;
- resell or redistribute the Service, or circumvent plan limits or technical restrictions.
4. Your account and content
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date. You retain ownership of the content you upload (photos, templates, event data). You grant SelaDevs a limited, worldwide licence to host, process, and display that content solely to provide the Service to you and your guests.
5. Intellectual property
SelaDevs retains all right, title, and interest in the Service, including software, documentation, and branding. Subject to these Terms and your paid plan, we grant you a limited, non-exclusive, non-transferable right to use the Service.
6. Payments, subscriptions, taxes and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
7. Service availability
We work hard to keep SelaBooth reliable but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Scheduled maintenance and events beyond our reasonable control (force majeure) may affect availability.
8. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties including merchantability and fitness for a particular purpose. To the maximum extent permitted by law, SelaDevs' aggregate liability under these Terms is capped at the fees you paid to us (or via Paddle for the Service) in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
9. Indemnity
You will indemnify SelaDevs against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. On termination, we will provide a reasonable window to export your data, after which it may be deleted in accordance with our retention practices.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of Malaysia, and disputes are subject to the exclusive jurisdiction of the courts of Malaysia, unless mandatory local law provides otherwise.
13. Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
